Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FocusPro AI ("we," "us," or "our") governing your access to and use of the FocusPro AI mobile application (the "App"), including all features, content, and services made available through the App.

By downloading, installing, or using the App, you affirm that you are at least 13 years of age, that you have the legal capacity to enter into a binding agreement, and that you agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

FocusPro AI is a productivity application available on iOS and Android that provides:

• Customizable focus timers and Pomodoro technique cycles
• AI-powered productivity coaching and session analysis via an integrated AI assistant
• Task management with recurrence, reminders, and priority tracking
• Google Calendar integration for scheduling focus blocks and viewing events
• Productivity analytics, streak tracking, and detailed session history
• Home screen widgets for quick timer access on iOS and Android
• Optional cloud backup via Google Drive
• Customizable themes, sounds, and notification preferences

Certain features are available only with a Pro subscription. See Section 4 for subscription details.

We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We will endeavor to provide reasonable notice of material changes where practicable.

3. User Accounts & Responsibilities

3.1 Account and Profile

FocusPro AI does not require you to create an account with us to use the App. Your profile — including your name, avatar, and productivity goals — is stored locally on your device. If you choose to connect your Google account for Calendar sync or Drive backup, you do so subject to Google's terms of service.

3.2 Your Responsibilities

You are responsible for:

• Maintaining the security of your device and any connected Google account credentials.
• All activity that occurs under your device and App data.
• Ensuring that your use of the App complies with all applicable local, state, national, and international laws and regulations.
• The accuracy and content of any data you enter into the App, including task descriptions, notes, and profile information.
• Any costs associated with your internet data usage when using App features that require network connectivity.

3.3 Google Account Integration

If you connect a Google account to enable Calendar sync or Drive backup, you are also subject to Google's Terms of Service (policies.google.com/terms). You may revoke the App's access to your Google account at any time through your Google account settings.

4. Subscription & Billing

4.1 Subscription Plans

FocusPro AI offers the following plans:

Prices are in US dollars and may vary by region due to App Store or Play Store regional pricing. Applicable taxes may be added at checkout.

4.2 Billing and Payment Processing

All subscription purchases and one-time purchases are processed exclusively through the Apple App Store (for iOS) or Google Play Store (for Android). We do not collect or store your payment card information. Billing is governed by the payment terms of the respective platform.

Subscription management (including upgrading, downgrading, or cancelling) is handled through your App Store or Google Play account settings. Subscription entitlements are verified in real time via RevenueCat.

4.3 Auto-Renewal

Monthly and Yearly Pro subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current subscription period. You can manage and cancel your subscription in your App Store or Google Play account settings.

4.4 Free Trial

We may offer free trial periods for Pro subscriptions from time to time. The terms and duration of any free trial will be clearly communicated at the point of sign-up. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

5. Refund Policy

All purchases of FocusPro AI subscriptions and in-app purchases are handled by Apple or Google through their respective platforms. Refund requests are subject to the refund policies of Apple or Google, not FocusPro AI.

• iOS / App Store: Refund requests must be submitted to Apple directly at reportaproblem.apple.com. Apple's standard refund policy applies.
• Android / Google Play: Refund requests must be submitted through the Google Play Store. Google's standard refund policy applies, including the 48-hour refund window for most purchases.

We are unable to process refunds directly. If you believe there has been an error with a purchase, please contact the relevant platform's support team. You may also contact us at support@focusproai.app and we will do our best to assist.

6. Intellectual Property

6.1 Our Intellectual Property

The App, including but not limited to its design, code, graphics, icons, sounds, themes, user interface elements, AI models integration, and all other content, is the exclusive property of FocusPro AI or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial productivity purposes, subject to these Terms.

6.2 Your Content

You retain ownership of all data and content you create within the App, including tasks, notes, and session records. By using the App, you grant us no rights to your content beyond what is strictly necessary to operate the features you use (such as transmitting AI chat messages to the AI service provider).

6.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of our App or its source code.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where permitted by applicable law.
• Remove, alter, or obscure any proprietary notices or labels on the App.
• Use the App's name, logo, or branding in any way without our prior written permission.

7. Prohibited Uses

You agree not to use the App in any way that:

• Violates any applicable local, state, national, or international law or regulation.
• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempts to probe, scan, or test the vulnerability of any system or network connected to the App.
• Attempts to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the App's connected services.
• Impersonates another person or entity, or falsely states or misrepresents your affiliation with a person or entity.
• Uses automated means (bots, scrapers, scripts) to access the App or its connected services in a manner that exceeds normal individual human use.
• Sends any content through the AI assistant feature that is illegal, harmful, or violates applicable laws.
• Attempts to circumvent, disable, or interfere with subscription verification or license enforcement mechanisms.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure at all times.
• Any errors or defects in the App will be corrected.
• The App or the server that makes it available are free of viruses or other harmful components.
• The AI assistant will provide accurate, complete, or appropriate advice for your specific situation. AI-generated content is provided for informational and motivational purposes only and should not be relied upon as professional advice.
• The results obtained from using the App will meet your productivity goals or expectations.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOCUSPRO AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App.
• Any conduct or content of any third party in connection with the App.
• Any content obtained from the App, including AI-generated responses.
• Unauthorized access, use, or alteration of your transmissions or content.
• Loss or corruption of your data stored locally on your device.
• Any interruption or cessation of the App or connected third-party services.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless FocusPro AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including but not limited to any use of the App's content, AI features, or services other than as expressly authorized in these Terms.

11. Third-Party Services

The App integrates with third-party services including Google (Sign-In, Calendar, Drive), RevenueCat, and Sentry. Your use of these services within the App is subject to the respective terms of service of each provider. We are not responsible for the availability, accuracy, or practices of any third-party service. Links to third-party terms are provided in our Privacy Policy.

12. Termination

These Terms remain in effect as long as you use the App. You may terminate your agreement with us at any time by uninstalling the App from your device and ceasing all use.

We reserve the right to suspend or terminate your access to the App, at our sole discretion, immediately and without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or used the App in a manner harmful to us or other users.

Upon termination, all rights and licenses granted to you under these Terms will immediately cease. Sections 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) shall survive termination.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be subject to binding arbitration or the exclusive jurisdiction of the courts of competent jurisdiction, as applicable under local law.

Before initiating any formal dispute resolution, you agree to first contact us at support@focusproai.app and allow 30 days for us to attempt to resolve the issue informally.

If you are an EU consumer, you may also have the right to submit a complaint to your local supervisory authority or use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce that provision in the future.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FocusPro AI regarding your use of the App and supersede all prior agreements, representations, and understandings, whether written or oral.
